Phoenix – October 11, 2011 – Communications Integrators, Inc. (Cii) has sued former employee, John Owens, and CablesToGo™ alleging that Mr. Owens took with him certain trade secrets and proprietary information belonging to Cii regarding the guestLINK™ connectivity panel.  The defendant filed a motion to dismiss the case and on August 31, 2011 the court denied the motion in its entirety and directed the case to proceed. 

Cii alleges that Mr. Owens used Cii’s protected information with CablesToGo™ to unfairly and improperly compete.  Instead of answering the allegations, Mr. Owens and his new employer filed a motion to dismiss, which sought dismissal of each of the separate Cii claims on a variety of legal arguments.  The court rejected all of the arguments in the motion and ordered Mr. Owens and CablesToGo™ to answer the complaint and proceed with the lawsuit concluding, “the Plaintiff’s claims for tortuous interference with Business Expectancy and Breach of Fiduciary Duty are viable causes of action as a matter of law as alleged in the complaint.”
