CALGARY,
September 1,
2010 - Guest Tek Interactive Entertainment Ltd., ("Guest-tek" or
"the Company"), a world-class provider of broadband technology
solutions to the hospitality industry, announced that on July 9, 2009,
it
commenced a civil action against its former employee, Thomas Pullen,
and PureHD
Inc., claiming breach of fiduciary duty by Mr. Pullen, misappropriation
of
Guest-Tek’s confidential, trade secret and proprietary business
information,
violation of the Computer Fraud and Abuse Act (18 U.S. C. § 1030 et seq.), violations of the Lanham Act
(15 U.S.C. § 1123(a)), unfair and deceptive acts and practices
(Mass. G.L. c.
93A), and related common law claims. Following
the defendants’ filing of a Motion seeking to
dismiss a number
of the claims asserted by Guest-Tek, the Court allowed Guest-Tek to
proceed
with all claims except the unfair and deceptive acts and practices
claim
against Pullen individually. As a
result of
information revealed during the discovery process, on March 19, 2010,
Guest-Tek
filed a Motion to Amend the Complaint together with the proposed First
Amended
Complaint, by which Guest-Tek seeks to add SolutionInc Ltd.
(“SolutionInc”) and
its President and Chief Executive Officer, Glen Lavigne, as defendants
to the
action. The proposed Amended Complaint
includes claims against Lavigne and SolutionInc for civil conspiracy,
misappropriation of Guest-Tek’s trade secrets, aiding and abetting
Pullen’s
breach of fiduciary duty, aiding and abetting Pullen’s and PureHD’s
conversion
